For the purpose of this chapter, an “open public way” shall be any street, alley, pedestrian walkway or easement which has been legally platted or which has been dedicated and formally accepted by the city of North Bend, and which has also been opened to public use by the city or opened to use by a holder of a franchise from the city or which is the subject of a proceedings commenced by the city of North Bend for the improvement thereof.
