If any curb cut shall be installed without a permit or contrary to the terms or conditions of a permit, or if the owner of property shall fail to remove a curb cut as required in NBCC 12.24.040 within 60 days after the mailing or delivery of written notice from the building official, then the city may perform the work of removing the curb cut and charge the cost thereof against the property as a special assessment and it shall become a lien upon the property to be collected in the same manner as a public improvement lien.
