(1) When the co-managers determine that an emergency exists (a threat to cause or is causing danger of injury or death to persons or damage to or the destruction of property, such that extraordinary measures must be taken to protect the public health, safety, and welfare), they will make a recommendation to the mayor for a declaration of emergency.

(2) The mayor shall make a declaration to that effect, and within 24 hours, call a special meeting of the city council to ratify the declaration of emergency, or if a quorum of the council is not available, then as soon as a quorum can be assembled. If the mayor, for any reason, is unable or unavailable to perform these duties, then the duties shall be performed in the following order of succession:

(a) City council president;

(b) City council members in order of seniority in office.

(3) The declaration of emergency shall state:

(a) The nature of the emergency;

(b) The geographical boundaries of the area subject to emergency procedures;

(c) The duration of time during which the area so designated shall remain an emergency area; and

(d) State any special regulations imposed as a result of the state of emergency.

(4) The declaration shall authorize the specific emergency powers by the co-managers for the duration of the period of time set forth in the ratification.

(5) Upon determination that all local resources, including all mutual aid, have been expended, that the emergency is continuing, and that the city is no longer able to adequately respond to the emergency, the co-managers shall seek assistance through Coos County Emergency Management.

(6) The co-managers shall immediately forward requests and preliminary assessment (including injuries, deaths and property damage or loss) to Coos County Emergency Management.

(7) If Coos County is unable to fill the requests made by the city of North Bend, the declaration and requests for assistance will be forwarded to Oregon Emergency Management for assistance.

(8) Per ORS Chapter 401, the size of the incident may constitute a state or federal disaster declaration. (Ord. 2073 § 1 (Exh. A), 2024; Ord. 1899 § 6, 2002. Formerly 2.24.060)
