If the city council grants the relief provided in ORS 195.310(4)(b), and the claimant’s, or their successor’s, use of the property in accordance with such relief causes a reduction in value of other property located in the vicinity of the claimant, the owner of the property that is reduced in value shall have a cause of action in state circuit court to recover from the claimant, or their successor, the amount of the reduction. The prevailing party in such an action shall also be entitled to an award of reasonable attorney’s fees. (Ord. 1977 § 8, 2010)
