For the purpose of this chapter, the following definitions will apply:

“Camp” or “camping” means to pitch, erect, create, use, or occupy camp facilities for the purposes of habitation, as evidenced by the use of camp paraphernalia.

“Camp facilities” includes, but is not limited to, tents, huts, temporary shelters, or vehicles.

“Camp paraphernalia” includes, but is not limited to, tarpaulins, cots, beds, sleeping bags, blankets, mattresses, hammocks, or outdoor cooking devices or utensils and similar equipment.

“Established campsite” means any place where one or more persons have established temporary sleeping accommodations by use of camp facilities and/or camp paraphernalia for a period of 72 or more hours.

“Family” means any person or group of persons living within a single housekeeping unit.

“Keeping warm and dry” means using measures necessary for an individual to survive outdoors given the environmental conditions, except that it does not include using any measure that involves fire or open flame.

“Motor vehicle” has the meaning given that term in ORS 801.360.

“Park areas” means those parks and recreation facilities identified in the city of North Bend parks and recreation master plan.

“Parking lot” means a developed location that is designated for parking vehicles, whether developed with asphalt, concrete, gravel, or other material.

“Prohibited campsite” means any campsite described in this chapter or not authorized under the North Bend City Code (NBCC).

“Public property” means lands that are open to the public, premises, and buildings, including but not limited to any building used in connection with the transaction of public business or any lands, premises or buildings owned or leased by the state of Oregon or any political subdivision therein and includes public rights-of-way. Public property may not be open to the public.

“Public rights-of-way” means the area between boundary lines of a public street or other public easement that is reserved, used, or to be used for a public street, alley, or pathway.

“Recreational vehicle” has the meaning given that term in ORS 174.101.

“Sanitary facilities” means any facility designed and intended for the disposal or collection of sewage.

“Sensitive area” means natural resources to be protected by resolution.

“Solid waste” means any garbage, trash, debris, yard waste, food waste, or other discarded materials.

“Solid waste disposal services” means contracted solid waste collection service for a campsite with the city’s exclusive franchisee for the collection of solid waste.

“Store” or “storage” means to put aside or accumulate for use when needed, to put for safekeeping, to place or leave in a location.

“Street” has the meaning given that term in NBCC 10.12.020.

“Temporary” means for a period of 90 days or less.

“Unsanitary” means a hazard to the health and safety of the public, to include but not be limited to human waste, bodily fluids, or chemical contamination.

“Vehicle” means any motor vehicle or trailer required to be licensed by the state of Oregon.

“Waterway” means Coos Bay, Pony Creek, or any major tributary thereof. (Ord. 2069 § 2, 2023)
