(1) Violations of this chapter shall be classified for the purpose of sentencing into the following categories:

(a) Class A violations;

(b) Class B violations;

(c) Class C violations;

(d) Unclassified violations, as described in subsection (2) of this section;

(e) Specific fine violations, as described in subsection (3) of this section.

(2) A violation described in this chapter that does not specify the classification of the violation is an unclassified violation. An unclassified violation is a Class B violation.

(3) A specific fine violation is a violation described in this chapter that:

(a) Is not designated as a Class A, B, or C violation; and

(b) Is punishable by a specific fine or civil penalty as the penalty for committing the violation.

(4) Except as provided in subsection (5) of this section, a sentence to pay a fine for a violation shall be a sentence to pay an amount not exceeding:

(a) Seven hundred fifty dollars for a Class A violation;

(b) Five hundred dollars for a Class B violation;

(c) Two hundred fifty dollars for a Class C violation;

(d) The amount otherwise established for any specific fine violation.

(5) If a person has gained money or property through the commission of a violation, instead of sentencing the defendant to pay the fine provided in subsection (4) of this section, the court may sentence the defendant to pay the amount described in ORS 153.018(4). (Ord. 1979 § 3, 2010)
