A city permit is required for the demolition of any commercial structure over 120 square feet and any residential structure over 200 square feet.

Partial demolition of a building or structure for additions, remodels, or other alterations shall require a building permit associated with the addition, remodel, or alteration. The building official can waive the requirement for a building permit for work of a very minor nature when it is determined that no utilities will be affected, no other department review is required, and the work poses no danger to the public.

Demolition of buildings shall comply with an approved set of plans and conditions issued on the face of the permit as well as the following standards:

(1) It is unlawful for an owner or person in responsible charge of a building undergoing demolition to leave a portion of the building liable to collapse unsupported for more than two hours without suitable safeguards to prevent access to the unsafe portion of the building.

(2) The demolition of buildings and structures must be carried out in a safe and consistent manner in compliance with the conditions of approval issued by the city. Adjoining streets and sidewalks may not be littered with debris and must be kept clean. During the work, all receptacles, drop boxes, shafts, or piping used in the demolition work shall be covered in an approved manner.

(3) The owner or person in responsible charge shall remove all solid waste from the work area within five business days of completion of the demolition work unless the building official provides written authorization for a time extension.

(4) Any building sewer connection proposed to be abandoned as part of the building demolition work shall be marked, capped, and secured in a gastight and watertight manner in compliance with NBCC 13.12.030(9).

(5) Exposed or otherwise destabilized soil resulting from the demolition of buildings or structures shall be covered, planted, or otherwise stabilized in compliance with Chapter 15.20 NBCC. (Ord. 2057 § 1, 2022)
