Any person, firm or corporation which shall remove the vegetation from, expose or otherwise destabilize soil which is predominately dune or blow sand subject to being blown onto other public or private property, and the owner of the land on which the exposure or destabilization takes place, shall jointly and severally have the duty to replant, cover or otherwise stabilize such area before it shall cause damage to other public or private property. Such duty shall not apply to a building site for the period of 90 days from the issuance of a building permit or the period of construction plus 30 days, whichever period is the shorter.
