(1) Regular Meetings. The council shall hold regular meetings on the second and fourth Tuesday of each month, with the exception of designated holidays or when the council finds it necessary to designate another date due to conflicts.

(a) Meetings shall be called to order at 7:00 p.m.

(b) Meetings shall adjourn no later than 10:30 p.m., allowing one-hour increment extensions upon a majority vote of the council.

(c) Meetings shall generally be held in the city council chambers located at city hall. The mayor, in consultation with the city administrator and city attorney, may select an alternate location to hold a meeting if the alternate location is deemed to be necessary, prudent, in the best interests of the public, and legally permissible.

(d) All regular meetings are open to the public.

(e) If there is no business to transact or a quorum of the council cannot attend and there is no urgent necessity to have a meeting, the mayor, upon the recommendation of the city administrator, may cancel the meeting. Council members will be notified of the cancellation prior to notice being given to the public.

(2) Special Meetings. Special meetings may be called by the mayor, by request of three members of the council, or by the city administrator.

(a) Special meetings shall be noticed in accordance with Oregon’s Public Meetings Law, and, at a minimum, shall be noticed at least 24 hours prior to the meeting taking place.

(b) Notice of the special meeting shall be given to all members of the council, the city administrator and the city attorney via telephone and email.

(c) Notice of the special meeting shall be given to each recognized news media which has on file a written request for notice of special meetings, with notice being delivered via telephone, email, or personal delivery.

(d) All special meetings are open to the public.

(3) Emergency Meetings. Emergency meetings may be called by the mayor, by request of three members of the council, or by the city administrator.

(a) Emergency meetings are those meetings called with less than 24 hours’ notice. The council shall identify why the meeting could not be delayed 24 hours immediately after calling the meeting to order, with the same being specifically referenced in the meeting minutes.

(b) Notice of the emergency meeting shall be given to all members of the council, the city administrator and the city attorney via telephone and email.

(c) Notice of the emergency meeting shall be given to each recognized news media which has on file a written request for notice of emergency meetings, with notice being delivered via telephone, email, or personal delivery.

(d) All emergency meetings are open to the public.

(4) Executive Sessions. Executive sessions may be called by the mayor, by the request of three members of council, the city administrator, or the city attorney.

(a) With the exception of subsection (4)(b) of this section, only members of the council, the city administrator, the city attorney, and persons specifically invited by the city administrator or the council shall be allowed to attend executive sessions.

(b) Representatives of recognized news media may attend executive sessions, other than those sessions during which the council conducts deliberations with persons designated to carry on labor negotiations, or where the matter involves litigation, and the news media is a party to the litigation.

(c) No final action or final decision may be made in executive session.

(d) Information discussed in an executive session shall not be disclosed. At the beginning of each executive session the presiding officer shall read the following statement:

The North Bend city council will now meet in executive session pursuant to ORS 192.660 (insert the appropriate section), which allows the council to meet in executive session to (insert reason for the executive session).

Representatives of the news media, designated staff and contractors, and the council shall be allowed to attend the executive session. All other members of the audience are asked to leave the meeting. All persons attending the executive session, including the news media, are specifically directed not to report on or otherwise disclose any of the deliberations or anything said about these subjects during the executive session, except to state the general subject of the session as previously announced. No decision will be made in executive session.

(e) Members of the council must keep in complete confidence all written materials and verbal information provided to them in executive session, to ensure that the city’s position is not compromised. No mention of confidential information read or heard should be made to anyone other than the council members, city administrator or city attorney, provided they attended the executive session.

(f) All executive sessions shall be noticed in accordance with the same procedures outlined for a special meeting.

(5) Work Sessions. Work sessions are permitted to present information to the council so that the council is prepared for regular or special meetings. Work sessions may also be called to provide the council with desired or needed continuing educational opportunities.

(a) Work sessions shall be called to order at 4:30 p.m.

(b) Work sessions shall adjourn no later than 6:30 p.m., allowing one-hour increment extensions upon a majority vote of the council. Instead of extending a work session, a majority of the council may also agree to schedule an additional work session at a later date and time to continue its discussion.

(c) All work sessions are subject to Oregon’s Public Meetings Law and must be noticed in accordance with the same procedures used for noticing regular meetings.

(d) Work sessions are intended to allow for preliminary discussions, and the council is not permitted to take formal or final action on any matter at a work session.

(e) Work sessions are to be scheduled by the city administrator.

(f) The city administrator is to invite any relevant staff to work sessions so that the sessions are as productive as possible.

(6) Goal-Setting Sessions. Goal-setting sessions are a special type of work session of the council used to discuss the city’s goals, strategic plan, review progress on the city’s strategic plan, and discuss potential additions/amendments to the strategic plan.

(a) During each odd-numbered year the council shall undertake a comprehensive and exhaustive review of its strategic plan and identified goals, and if necessary update the same.

(b) During each even-numbered year the council shall review its strategic plan and identified goals to determine the progress, or lack thereof, that has been made towards obtaining the desired outcomes, and ensure the upcoming fiscal year budget has properly accounted for the strategic plan and identified goals.

(c) Goal-setting sessions are longer work sessions of the council which may have a duration between two to 10 hours, and may occur over multiple days.

(7) Holidays. In the event a regular meeting falls on a holiday recognized by the city, the regular meeting for that week shall be cancelled and rescheduled to be held at a date mutually agreed upon by the mayor and city administrator.

(8) Attendance. Members of the council are expected to attend all meetings and work sessions of the council, unless excused by the presiding officer. If a member cannot attend a meeting or work session of the council, they shall advise the mayor or city administrator if they will be unable to attend any meetings. If the mayor will be absent, they will inform the council president and city administrator. Under the charter, a council position becomes vacant if the member of council is absent from the city for more than 30 days without council permission or absent from all meetings of the council within a 60-day period without council permission.

(9) Absence from the City. Because of the possibility of special and emergency meetings, council members should normally advise the city administrator if they will be absent from the city for more than 24 hours if the absence will involve the member being in a location or involved in an activity that limits electronic communication.
