(1) Following an initial review and investigation of a complete claim, the city administrator shall forward a recommendation to the city council that the claim be:

(a) Denied;

(b) Investigated further;

(c) Declared valid, and waive or modify the land use regulation, or compensate the claimant upon completion of an appraisal; or

(d) Evaluated with the expectation of the city acquiring the property by condemnation.

(2) If the city administrator’s recommendation is that a claim be denied, then the city administrator may proceed without a public hearing, as provided in NBCC 2.76.060, unless two or more members of the city council notify the city administrator within 14 days that they want a public hearing on the matter, as provided in NBCC 2.76.070.

(3) If the city administrator’s recommendation is for anything other than a denial, the matter shall be scheduled for a public hearing, as set forth in NBCC 2.76.070. (Ord. 1977 § 5, 2010)
