(1) Upon a determination that the claim will be decided without a public hearing, pursuant to NBCC 2.76.050(2), the city administrator shall establish a deadline for the receipt of written comments and shall promptly provide the notice required by ORS 195.314(1).

(2) After the deadline for written comments has expired, the city administrator shall review the comments and:

(a) If the city administrator’s recommendation remains that the claim should be denied, the city administrator shall issue written notice of the city’s final determination of denial, pursuant to ORS 195.314(6).

(b) If the city administrator’s recommendation is for anything other than denial, the matter shall be scheduled for a public hearing, as set forth in NBCC 2.76.070. (Ord. 1977 § 6, 2010)
