The following codes, parts and provisions of codes, and regulations are hereby adopted and enacted to be enforced in the city of North Bend:

(1) The Oregon Structural Specialty Code, as adopted by OAR Chapter 918, Division 460, including the following optional provisions:

(a) Appendix G, Flood Resistant Construction.

(b) Appendix H, Signs.

(c) Appendix J, Grading.

(2) The Oregon Mechanical Specialty Code, as adopted by OAR Chapter 918, Division 440.

(3) The Oregon Residential Specialty Code, as adopted by OAR Chapter 918, Division 480.

(4) The Oregon Manufactured Dwelling Installation Specialty Code, as adopted by OAR Chapter 918, Division 500.

(5) The Oregon Fire Code, as adopted by OAR Chapter 837, Division 40.

(6) The 2021 International Property Maintenance Code, save and except such portions as deleted, modified or amended by this section, is hereby adopted and incorporated herein as fully as if set forth in full in this section and the same shall be controlling and enforced within the city limits of North Bend. In instances where the Oregon Specialty Codes, Oregon Fire Code, or Oregon Administrative Rules as listed above, or other provisions of this code, apply, such provisions shall govern, and those provisions of the International Property Maintenance Code which conflict or overlap with such provisions shall not apply. When no provisions of the Oregon Specialty Codes, Oregon Fire Code, or Oregon Administrative Rules as listed above apply, the building official shall have the authority to order compliance with the provisions of the International Property Maintenance Code which the building official judges to be applicable. The building official shall have authority to waive compliance with any provisions of the International Property Maintenance Code which the building official deems not to be applicable or pertinent. The judgment of the building official as to the applicability of any provisions of the International Property Maintenance Code shall be final. Violations of conditions of the International Property Maintenance Code are declared to be a danger to public health and safety and therefore are a nuisance to be abated as provided in Chapter 8.12 NBCC.

(a) Definitions. As used in this chapter, and referenced in the International Property Maintenance Code, the following terms are defined as follows:

(i) “Jurisdiction” shall mean the city of North Bend.

(ii) “International Building Code” shall mean the Oregon Structural Specialty Code or Oregon Residential Specialty Code, depending upon application.

(iii) “International Fire Code” shall mean the Oregon Fire Code.

(iv) “International Mechanical Code” shall mean the Oregon Mechanical Specialty Code.

(v) “International Zoning Code” shall mean the zoning ordinance of the city of North Bend in accordance with NBCC Title 18.

(b) Revisions, Modifications, and Deletions. The following sections of the International Property Maintenance Code are hereby revised, modified, or deleted as follows:

(i) Section 101.1 is revised as follows:

101.1 Title. These regulations shall be known as the International Property Maintenance Code of the City of North Bend.

(ii) Section 104.1 is revised as follows:

104.1 Fees. The fees for activities and services performed by the city in carrying out its responsibilities under this International Property Maintenance Code shall be as set by Council resolution.

(iii) Section 109.2 is revised as follows:

Notice of Violation. The code official shall serve a notice of violation or order in accordance with NBCC 8.12.020.

(iv) Section 302.4 is revised as follows:

Section 302.4 Weeds. All premises and exterior property shall be maintained free from weeds or plant growth in accordance with NBCC Chapter 8.12.

(v) Section 304.14 is deleted.

(vi) Section 602.3 is revised as follows:

Section 602.3 Heat Supply. Every owner or operator of any building who rents, leases or lets one or more dwelling units or sleeping units on terms, either expressed or implied, to furnish heat to the occupants there shall supply heat during the period of time from October 1 through May 15 to maintain a temperature of not less than 68 degrees Fahrenheit in all habitable rooms, bathrooms, and toilet rooms.

(vii) Section 602.4 is deleted.

(c) Nuisance Abatement Procedures. The procedure for nuisance abatement notice and appeal as set forth in Chapter 8.12 NBCC shall supersede Sections 107, 108, and 111.4 through 111.9 of the International Property Maintenance Code. (Ord. 2057 § 1, 2022)
