(1) Properties listed on the National Register of Historic Places, including all properties within National Register historic district boundaries, are eligible for listing on the designated landmarks register upon nomination for designation pursuant to this section. Only properties officially listed in the designated landmarks register shall be eligible for public incentives and subject to the regulations in this chapter. However, historic resources of statewide significance, regardless of whether or not those resources are listed in the designated landmarks register, are subject to the regulations set forth in NBCC 15.16.080.

(2) Historic resources within the corporate boundaries of the city of North Bend may be designated by the commission to the designated landmarks register using the procedures outlined in this section.

(3) Any individual or group, including the commission acting on its own initiative, may nominate a historic resource for inclusion in or removal from the city’s designated landmarks register by submitting a complete application to the city planning department. The burden of proof lies with the applicant. No property shall be so nominated or designated without the written consent of the owner(s).

(4) The commission shall establish standards for a complete application. See NBCC 15.16.100(1). Upon acceptance of a complete application the historic preservation officer shall schedule a public hearing pursuant to NBCC 18.60.040, and shall inform owner(s) in writing of the designation process and the owner’s right to support or object to the designation of the historic resource to the designated landmarks register under the provisions of ORS 197.772 and as it may be amended.

(a) An owner may object to the inclusion of the historic resource to the designated landmarks register at any time during the designation process. Such refusal to consent must be submitted on the public record and shall remove the historic resource from any consideration for designation to the designated landmarks register.

(b) An owner’s objection to the inclusion of a historic resource to the designated landmarks register does not remove the historic resource from the inventory of historic resources.

(c) A permit to demolish or modify a historic resource under consideration for inclusion to the designated landmarks register shall not be issued for 120 days from the date of the owner’s refusal to consent to designation.

(5) In order to be included or maintained on the designated landmarks register the commission must find that the historic resource:

(a) Is located within the boundaries of the city of North Bend.

(b) Is over 50 years of age or is of exceptional significance or, in the case of a district, the majority of the properties are over 50 years of age or have exceptional significance.

(c) Possesses sufficient historic integrity to convey its significant relationship to events or conditions of the human past.

(d) Has historic significance as demonstrated by meeting at least one of the following criteria:

(i) Is associated with events that have made a significant contribution to the broad patterns of local, state, or national history.

(ii) Is associated with the lives of persons, or groups of people, significant in local, state, or national history.

(iii) Embodies the distinctive characteristics of an architectural type, style, period, or method of construction or that represents the work of a master, or that possesses high artistic values, or that represents a significant and distinguishable entity whose components may lack individual distinction.

(iv) Yields or is likely to yield information which is important in local, state, or national history.

(6) The commission shall develop findings to support its decisions. These findings shall indicate those elements of a property, including interior, landscape, and archaeological features, that are included in the designation and subject to regulation under the provisions of this chapter.

(7) The commission shall approve or deny applications for listing on the designated landmarks register and shall adopt findings pursuant to this section. (Ord. 2051 § 1, 2021)
