(1) The commission may adopt additional protections regulating restoration, alterations, expansion, or new construction for properties listed in the National Register.

(2) Additional protections may be applied to properties listed in the National Register without owner consent under the provisions of OAR 660-023-0200(8)(b) and as it may be amended.

(3) Any person, group, or government agency may propose that a historic resource listed in the National Register be considered for additional protections. The process for applying additional protections is as follows:

(a) The proposal for applying additional protections to a building, structure, site, object, or district listed in the National Register must include the National Register nomination, and a complete list of the additional protections to be applied. The historic preservation officer may establish additional standards for a complete application.

(b) At a public hearing held subject to the procedures set forth in NBCC 18.60.040 and 18.60.045, the commission must consider all of the following factors:

(i) The historic characteristics identified in the National Register nomination.

(ii) The historic significance of the resource.

(iii) The goals and policies related to historic preservation in the city of North Bend comprehensive plan.

(iv) The effects of the additional protection measures on the ability of owners of historic resources identified as significant to maintain and modify features of those resources.
