(1) The purpose of this chapter is to define and describe certain civil offenses against the public peace, health, safety, and general welfare of the city of North Bend, to set forth the procedures to be followed for the enforcement of violations of the ordinances of the city, and to set forth the penalties to be imposed for such violations.

(2) It shall be deemed a violation of this chapter to:

(a) Commit any offense described in this chapter;

(b) Commit any offense described in any other city ordinance;

(c) Perform any action that is expressly prohibited by any city ordinance; or

(d) Fail to perform an action that is expressly required by any city ordinance.

(3) Any person who shall attempt to commit any violation defined in this chapter, but for any reason does not consummate the same, shall be deemed to have committed a violation under this chapter, and any person who aids and abets another in the commission of a violation under this chapter may be charged with its commission.

(4) Any person who is found guilty of committing a violation described in subsection (2) or (3) of this section shall be subject to a fine as described in NBCC 9.04.300 and shall also be subject to such other punishment as may be described by city ordinance, except that no such punishment shall include a term of imprisonment.

(5) The provisions of this chapter are intended to be severable, and if any portion of this chapter is adjudged by a court of competent jurisdiction to be invalid, then such decision shall not affect the validity of the remaining portions of this chapter. (Ord. 1979 § 1, 2010)
